General Terms and Conditions of Use

1. Introduction

Welcome to the website of Cozumel Tours by Cab (hereinafter, “the Company”). By accessing, browsing, or booking on this site, you agree to comply with these Terms and Conditions, which govern the relationship between the User and the Company for services operated directly or through third parties.

2. Definitions

User: Any individual or entity that browses the website or books tourism services.

External Provider: Independent third parties contracted through the website to provide tourism services.

Tour Operator: An individual or entity designated by the Company or the Provider to carry out the tour.

Visited Establishment: Restaurants, parks, private beaches, shops, or other sites included in the tourism experience, operating under their own rules.

Force Majeure: Extraordinary situations such as weather events, accidents, conflicts, pandemics, government shutdowns, etc.

3. Scope of Service

Cozumel Tours by Cab offers tourism services in Cozumel, either directly or through selected third parties. The Company acts as:

Direct provider, when tours or services are carried out by Company personnel.
Intermediary, when connecting the User with an External Provider. In this case, the Company is not responsible for the execution, conditions, or incidents occurring during the direct service provided by the third party.

4. Relationship with Visited Establishments

During tours, operators may take Users to establishments or sites with internal policies, entry requirements, codes of conduct, and their own regulations. The Company is not responsible for operational decisions, additional charges, or conditions imposed by these establishments.

Users are responsible for complying with the rules of each location. The Company shall not be held liable for damages, disputes, or removals resulting from non-compliance with such rules.

5. User Obligations

Users agree to:

Provide truthful and complete information when booking.
Arrive punctually at the indicated meeting points.
Follow the instructions of the guide or operator during the tour.
Respect the rules of the visited establishments.

6. Payments and Confirmations

All bookings require full payment via the available methods on the website.
Confirmation will be sent by email once payment is received.
Prices are shown in Mexican pesos and include applicable taxes unless otherwise stated.

7. Changes, Rescheduling, and Cancellations

7.1 By the User

More than 48 hours in advance: Full refund.
Between 24 and 48 hours: 50% refund.
Less than 24 hours or no-show: No refund.

7.2 By the Company or the Provider

In case of cancellation due to bad weather, low demand, logistical issues, or force majeure, the following will be offered:

Rescheduling.
Alternative activity of similar value.
Full refund.

7.3 Changes by the User

Changes to the date or type of tour are subject to availability and may incur additional charges.

8. Limitation of Liability

The Company shall not be liable for:

Personal injuries, losses, or thefts during the tour or at visited establishments.
Errors or negligence by External Providers.
Expenses derived from personal decisions by the User (e.g., leaving the tour or engaging in off-itinerary activities).

Users acknowledge that they participate voluntarily in the contracted activities and assume the risks inherent to each experience.

9. Insurance

The Company recommends purchasing travel insurance that covers personal accidents, medical emergencies, and cancellations. Some tours include basic insurance, as specified in the service description.

10. Applicable Law

These Terms and Conditions are governed by Mexican law. Any disputes shall be submitted to the competent courts in Cozumel, Quintana Roo.

11. Use of Personal Data

The personal data collected through the website will be used for the following purposes:

To manage and follow up on bookings.
To contact Users regarding their services.
For marketing purposes, including sending promotional content and service updates.

By using this site, you accept our Privacy Policy and authorize the use of your data for the purposes outlined above.

Unauthorized use may result in legal action and claims for damages.
